03

Subject of the Agreement

This Agreement regulates the rights and obligations of the parties regarding the Product ordered electronically by the Buyer through the Site, in accordance with Law No. 6502 on Consumer Protection and the provisions of the Distance Contracts Regulation.

Before the order is confirmed, the Buyer is provided electronically with a Preliminary Information Form containing information on the Product's essential characteristics, sales price, payment method, delivery information and matters relating to the right of withdrawal. This Agreement constitutes an integral whole together with the Preliminary Information Form; the information contained in the Preliminary Information Form forms an integral part of this Agreement.

04

Order and Formation of the Agreement

The Buyer completes the order by adding the selected Product to the cart through the Site, entering delivery and billing information, selecting the payment method, and approving the Preliminary Information Form and this Agreement.

Before confirming the order, the Buyer has the opportunity to check the Product quantity, unit price, total amount, delivery address and payment information. The order shall be deemed concluded upon the Buyer's approval and the Seller's electronic acceptance of the order; the order confirmation is notified to the Buyer by e-mail or through the Site.

05

Product Information and Essential Characteristics

The Product's essential characteristics (such as material, dimensions and description), sales price and, if applicable, production/preparation period are presented to the Buyer on the relevant product page and in the Preliminary Information Form.

It is stated that Product images may differ reasonably from the actual Product depending on screen and color settings; provided that such difference does not constitute a deviation from the Product's essential characteristics, it shall not be considered a defect. This provision does not eliminate the Buyer's statutory rights concerning defective goods.

06

Product Price and Payment

The Product price is the sales price displayed on the Site at the time of the order and determined in accordance with applicable legislation. The price and payment conditions applicable at the time the order is confirmed shall prevail.

Payment is made through the payment methods offered on the Site. The technical infrastructure relating to the security of payment transactions is provided by the relevant payment service providers.

A price change occurring after the order has been completed does not affect the Buyer's statutory rights regarding the completed order.

Campaigns, discounts or coupons may be subject to separately announced campaign conditions; such conditions do not eliminate the Buyer's statutory rights.

07

Custom Production and Production Process

Atelier Emine is a brand producing handmade couture bags, with extensive handcraftsmanship in its products and limited production quantities. Certain Products may be prepared upon order or in accordance with the Buyer's request/personal needs.

This production model means that the fact that a Product is handmade, couture or limited production does not, by itself, eliminate the right of withdrawal; the exception to the right of withdrawal shall apply only where the conditions expressly provided for under applicable legislation are specifically met (see Article 13).

After the production process of a made-to-order Product has commenced, the status of the process and, where applicable, the production stages may be reasonably communicated to the Buyer.

08

Delivery and Shipping

The delivery process consists of two stages: preparation/production of the Product and delivery of the Product to the Buyer after it has been handed over to the shipping company.

After the preparation/production process has been completed, the Product is handed over by the Seller to the contracted shipping company. In cases of loss, damage or delay occurring during transportation after handover to the shipping company, the liability of the Seller and the carrier shall be assessed within the framework of applicable legislation and the agreement with the carrier; the Seller continues to assume its statutory liability for events occurring after handover to the carrier and does not completely disclaim such liability.

09

Delivery Period

The Seller is obliged to deliver the order to the Buyer or to the person/entity at the address designated by the Buyer within the period specified in the Preliminary Information Form or on the product page; if no such period is specified, within the maximum period prescribed by applicable legislation.

The maximum delivery period prescribed under the applicable Distance Contracts Regulation shall be verified against the current legislation applicable on the order date and entered here as the exact number of days.

For Products prepared upon order, the preparation/production period and shipping delivery period operate separately; the preparation period specified on the product page or in the Preliminary Information Form is expressly communicated to the Buyer as part of the delivery period.

10

Matters to Which the Buyer Should Pay Attention During Delivery

The Buyer should check whether the Product packaging is damaged at the time of delivery; if damage to the packaging is detected, the Buyer may notify the shipping representative by means of a written report before accepting the Product. Acceptance of a Product whose packaging appears damaged does not eliminate the Buyer's statutory rights concerning defective goods.

11

Right of Withdrawal

The Buyer has the right to withdraw from the distance contract concerning the purchased Product within the period prescribed by applicable legislation, without providing any reason and without paying any contractual penalty.

The withdrawal period shall be verified according to the applicable provision of the Distance Contracts Regulation and entered here as the exact number of days; under the current version of the regulation, this period is regulated as a period beginning from the date of delivery.

The starting date of the withdrawal period for sales of goods is the date on which the Product is delivered to the Buyer or to a third party designated by the Buyer at the designated address. Where multiple Products in the same order are delivered separately, the starting date of the withdrawal period shall be determined according to the special provision under applicable legislation.

12

Exercise of the Right of Withdrawal

The Buyer shall notify the Seller of the intention to exercise the right of withdrawal, before the withdrawal period expires, by means of a clear statement addressed to the Seller (through the communication channels on the Site, by e-mail, or through the contact information provided on the Company Information page).

Where the right of withdrawal is exercised, the Buyer is obliged to return the Product to the Seller within the period prescribed by applicable legislation following the withdrawal notification. If the Product is returned used, damaged or incomplete beyond reasonable wear arising from ordinary use, such condition shall be assessed in accordance with applicable legislation.

13

Exceptions to the Right of Withdrawal

The right of withdrawal shall not apply to Products falling within the exceptions specified in the applicable Distance Contracts Regulation, only where the conditions required by the relevant statutory exception are specifically met.

These exceptions may include, to the extent provided by legislation, provisions concerning goods prepared in accordance with the consumer's requests or personal needs. However, merely characterizing a Product as handmade, couture, limited production or "custom-made" is not, by itself, sufficient for applying this exception; for the exception to apply, the Product must specifically meet the conditions required by legislation (for example, having been prepared directly according to the Buyer's specific request in a manner that distinguishes it from a standard product).

The final assessment of which Product categories fall within this exception should be made separately for each Product based on current legislation and case law; this article sets out the general framework and does not create an automatic list of exceptions.
14

Information Regarding the Right of Withdrawal

The Buyer receives information concerning the conditions, period and procedure for exercising the right of withdrawal through the Preliminary Information Form and the relevant provisions of this Agreement.

If the Buyer has not been informed about the right of withdrawal in the manner prescribed by legislation, the legal consequences arising therefrom shall be subject to applicable legislation; this Agreement does not alter such consequences to the detriment of the Buyer.

15

Refund

Where the right of withdrawal is duly exercised, the amount paid by the Buyer and, where applicable, delivery costs shall be refunded within the period prescribed by applicable legislation and using the same payment method used by the Buyer.

The maximum period within which the refund must be made shall be verified against the current legislation and entered here as the exact number of days.

The Seller shall not apply any additional deduction, processing fee or contractual penalty not provided for under applicable legislation.

16

Defective Goods and Other Statutory Consumer Rights

In the event that the Product is defective, the Buyer may exercise any of the rights to rescind the contract, request a reduction in the sales price, request free repair, or request replacement with an equivalent non-defective product. These rights are not restricted because the Product is handmade, couture or custom-made; material/workmanship characteristics inherent to the nature of the Product and expressly disclosed to the Buyer before sale are excluded from the assessment of a "defect" in the legal sense, provided that this does not eliminate the consumer's general statutory rights concerning defective goods.

17

Warranty and After-Sales Rights

If Atelier Emine has separately and expressly published a warranty or maintenance service relating to the Product, the scope and conditions of such service shall be specified in the relevant published text and separately provided to the Buyer.

This Agreement does not contain any warranty period or after-sales service commitment that has not been separately and expressly offered by the Seller. The Buyer's statutory rights arising from defective goods (Article 16) remain valid in all cases independently of any additional services that may be specified in this article.

18

Product Use and Damage

Use of the Product outside its ordinary intended purpose, storage under inappropriate conditions or damage caused by the Buyer's fault shall be assessed outside the scope of defective goods. This provision does not affect the Buyer's statutory rights concerning defects arising from the production or materials of the Product.

19

Protection of Personal Data

Detailed information regarding the processing of the Buyer's personal data is provided in the separately published KVKK Information Notice. This Agreement does not replace the KVKK Information Notice.

20

Intellectual and Industrial Property Rights

The trademarks, logos, product designs, product photographs, video content, texts, graphic works and collection names appearing on the Site belong to Atelier Emine and are protected under applicable intellectual and industrial property legislation. These contents may not be used for commercial purposes, reproduced or republished without the Seller's written permission.

21

Seller's Rights and Obligations

The Seller is obliged to deliver the Product in conformity with the Agreement, with the characteristics specified in the order and, where applicable, in accordance with legal requirements, and to inform the Buyer in accordance with applicable legislation regarding the order process, right of withdrawal and matters relating to the Product.

The Seller reserves the right, in cases such as suspicion of a fraudulent order, incorrect or incomplete communication/delivery information provided by the Buyer, inability to complete delivery due to reasons attributable to the Buyer, or failure of the Buyer to accept the Product within a reasonable period, to reasonably postpone the order, contact the Buyer or cancel the order in accordance with applicable legislation.

22

Buyer's Rights and Obligations

The Buyer is obliged to provide accurate and up-to-date information during the order process, ensure access to the delivery address and accept the Product in accordance with applicable legislation.

The Buyer may exercise the right of withdrawal, rights concerning defective goods and other statutory rights under this Agreement within the framework of applicable legislation.

23

Force Majeure

Earthquake, flood, fire, epidemic disease, war, acts of terrorism, general infrastructure outages, decisions of official authorities and similar unforeseeable events occurring outside the reasonable control of the parties shall be considered force majeure. In the event of force majeure, the parties shall not be held liable for failing to perform their respective obligations to the extent and for the duration affected by the force majeure event. The force majeure provision may not be used for the purpose of eliminating the Buyer's statutory rights.

24

Termination of the Agreement

This Agreement shall terminate upon completion of delivery of the Product subject to the order to the Buyer and fulfillment of the parties' obligations arising from the Agreement. In cases such as exercise of the right of withdrawal, rescission of the Agreement due to defective goods or other circumstances permitted by applicable legislation, the Agreement may terminate in accordance with the relevant provisions.

Termination of the Agreement does not eliminate consumer rights that arose before the termination date.

25

Applicable Law

This Agreement shall be governed by the laws of the Republic of Türkiye.

26

Resolution of Disputes

For disputes arising from this Agreement, Provincial/District Consumer Arbitration Committees shall have jurisdiction within the monetary thresholds announced annually by the Ministry of Trade, while Consumer Courts shall have jurisdiction over disputes exceeding these thresholds.

The current monetary threshold determining the distinction between applications to consumer arbitration committees and courts according to the value of the dispute shall be verified based on the amount officially announced by the Ministry of Trade for the relevant year and entered here.

The procedural rules under applicable consumer legislation shall apply in determining the competent arbitration committee and court; this provision does not eliminate the Buyer's statutory rights regarding jurisdiction.

27

Effective Date

This Agreement shall enter into force between the parties as of the order date upon the Buyer's placement and confirmation of the order through the Site.

Agreement text: Current as of August 29, 2026, and may be updated as necessary in accordance with applicable legislation.
