ATELIER EMINE USER / MEMBERSHIP AGREEMENT

1. Parties

This Agreement is made between Atelier Emine (“Seller”, “Site Owner”, “Brand”) on one side and the natural or legal persons who are members of the Site (“Member”, “User”) on the other side, regarding the use of online services and products.

By completing the registration process on the Site, the Member is deemed to have read, understood, and accepted all the terms of this Agreement.

2. Definitions

• Website: www.atelieremine.com

• Product: All fashion accessories, bags, jewelry, watches, and similar items offered for sale on the site.

• Services: Membership, shopping, payment, promotions, and other site-related digital or physical services.

• User Account: The personal account created by a member when registering on the Site.

• Campaign: Promotions, discounts, and special offers run on the site.

• Force Majeure: Strikes, earthquakes, floods, war, terrorism, pandemics, or other unforeseen circumstances.

• KVKK: Law No. 6698 on the Protection of Personal Data.

• Regulation on Distance Contracts: Official Gazette No. 2014/6500.

3. Membership Terms and Registration Procedures

1. Members must be at least 18 years old. Individuals under 18 cannot become members without the permission of their legal guardian.

2. The member declares that the information provided during registration is accurate, complete, and up-to-date. In case of incorrect information, the Seller reserves the right to unilaterally cancel the membership.

3. The member agrees not to share their account information with third parties, to keep their password confidential, and to ensure its security.

4. The member agrees not to violate applicable laws, general morals, or Site rules while using the Site.

5. Members may not use the Site for commercial purposes or reproduce, sell, or distribute products without the Seller's prior consent.

4. User Account Usage and Security

1. Account security is entirely the member's responsibility.

2. The Seller must be immediately informed of any unauthorized use of the account username and password.

3. The seller may temporarily suspend the account if they detect suspicious activity.

4. In the event of account closure or suspension, the Seller is not liable for any compensation.

5. The member accepts full responsibility for their account.

5. Provision of Services and Terms of Use

1. Sellers offer products and services to Members through the Site.

2. Reasonable efforts will be made to ensure the continuity and accuracy of services; however, the Seller cannot be held liable for service interruptions due to technical malfunctions, internet outages, or force majeure events.

3. The member shall use the Site only within the scope of this Agreement and in accordance with the law.

6. Ordering and Payment Procedures

1. The member places an order and makes a payment through the Site.

2. Payment is received by the Seller through a secure payment infrastructure.

3. The seller will initiate the procurement and shipping process for the product once payment confirmation is received.

4. The Seller reserves the right to refuse or cancel orders for products that are out of stock.

5. The security of payment information is the responsibility of the Member; the Seller is not responsible for unauthorized payments made by third parties.

6. The member declares that their credit card or bank information is accurate and belongs to them.

7. Delivery and Shipping

1. Product delivery will be made via the shipping company specified by the Seller after Order Confirmation.

2. Delivery time depends on product stock availability and the shipping company; the Seller is not responsible for delays.

3. The member is responsible for checking that the product is complete and undamaged upon delivery.

4. Any damage that occurs during shipping is assessed by the shipping company and insurance company.

8. Return, Cancellation and Exchange Policy

1. The member may exercise their right of withdrawal within 14 days, in accordance with the Regulation on Distance Contracts.

2. The return request must be submitted to the Seller in writing within 14 days of product delivery.

3. The returned product must be unused, in its original packaging, and accompanied by the invoice.

4. Custom-made, bespoke, or hygienic products are not eligible for return.

5. The seller will process the refund within 14 days after inspecting the returned product.

9. Member Obligations

1. You may not use the site for commercial purposes, reproduce or distribute products.

2. You may not modify or provide the site content and software to third parties.

3. The member agrees not to infringe the rights of third parties while using the Site.

4. The Member is obligated to refrain from actions that could damage the Seller's business reputation.

10. Seller's Limitations of Liability

1. The seller cannot be held liable for any direct or indirect damages arising from the use of the products.

2. Access to the site may be disrupted due to technical malfunctions, maintenance, or force majeure; the Seller is not liable for compensation.

3. Product images and descriptions are as accurate as possible; color and size variations may occur due to technical reasons.

11. Intellectual Property Rights

1. Site content, brand logos, designs, and images belong to the Seller.

2. Members may not copy, reproduce, or use this content for commercial purposes without the Seller's permission.

12. Protection of Personal Data

1. The member acknowledges that their personal data is processed in accordance with the Personal Data Protection Law (KVKK) and relevant legislation.

2. The seller may only use personal data for membership, order, marketing, and service improvement purposes.

3. Members can exercise their rights under the Personal Data Protection Law (KVKK).

13. Force Majeure

1. The seller is not responsible for service disruptions caused by strikes, earthquakes, floods, war, terrorism, pandemics, or other unforeseen circumstances.

2. In case of force majeure, the Seller reserves the right to inform the Member.

14. Contract Amendments

1. The seller may amend the Agreement by giving prior notice.

2. Continued use of the Site after the changes constitutes acceptance of those changes.

15. Dispute and Competent Court

1. The courts and enforcement offices of Istanbul (Anadolu) Courthouse shall have jurisdiction over any disputes arising from this Agreement.

2. First, a solution is sought through negotiation and mediation.

16. Additional Technical and Legal Articles

1. Product Warranties: Products are covered by a 6-month warranty against manufacturing defects.

2. Order Cancellation Procedure: Members can request order cancellation before the product is shipped; payments will be refunded within 7 business days after cancellation.

3. Payment Systems Security: All payments are protected by SSL and PCI DSS standards.

4. Logging and User Approvals: Member transactions are logged by the system and have legal validity.

5. Data Encryption and Storage: Member data is stored using AES-256 encryption and is accessible only to authorized personnel.

17. Entry into Force and Validity

This Agreement enters into force upon the Member completing the registration process on the Site and remains valid as long as the Member's account is active.
